Home / Medical Malpractice / Failure To Diagnose Ectopic Pregnancy
An ectopic pregnancy occurs when a fertilized egg implants outside the uterus, most often in a fallopian tube. Because the pregnancy cannot progress normally, it poses a life-threatening risk to the mother if not diagnosed and treated quickly. As the pregnancy grows, the fallopian tube may rupture, causing massive internal bleeding, infertility, or death.
Failure to diagnose ectopic pregnancy is a serious form of malpractice. With proper evaluation—including pregnancy testing, ultrasounds, and physical examination—ectopic pregnancies can usually be identified early. When doctors dismiss or overlook symptoms, however, women are left vulnerable to catastrophic harm. The result may be emergency surgery, loss of reproductive organs, or preventable maternal death.
Ectopic pregnancy affects 1–2% of all pregnancies in the United States, according to the American College of Obstetricians and Gynecologists (ACOG). That translates to tens of thousands of women each year. Tragically, ectopic pregnancy is a leading cause of maternal mortality in the first trimester.
Studies show that delays in diagnosis contribute to the majority of deaths associated with ectopic pregnancy. The Centers for Disease Control and Prevention (CDC) has reported that nearly 10% of pregnancy-related deaths in the U.S. are due to ectopic pregnancies. Many of these cases are preventable with timely recognition and intervention.

Ectopic pregnancy misdiagnosis often begins with failure to take symptoms seriously. Women may present with abdominal pain, vaginal bleeding, dizziness, or shoulder pain, but providers dismiss these complaints as menstrual irregularities, gastrointestinal issues, or urinary tract infections. When pregnancy is not considered, the risk of ectopic pregnancy is overlooked.
Failure to order appropriate tests is another common issue. Any woman of childbearing age presenting with abdominal pain or bleeding should be given a pregnancy test. If positive, physicians must follow up with ultrasounds and hormone testing (such as beta-hCG levels) to confirm whether the pregnancy is viable and located in the uterus. When these steps are skipped, ectopic pregnancies remain undetected until they rupture.
Bias and assumptions also play a role. Providers may dismiss younger patients, uninsured women, or those with atypical symptoms. In busy emergency rooms or urgent care centers, these women are often discharged prematurely without proper evaluation.
Certain scenarios appear repeatedly in lawsuits involving ectopic pregnancy misdiagnosis. One involves women discharged from the ER after being told they have a “miscarriage” or “normal cramping,” only to collapse days later from a ruptured tube. Another involves patients with known risk factors—such as prior pelvic infections, fertility treatments, or history of ectopic pregnancy—who are not adequately evaluated despite warning signs.
Delayed diagnosis often leads to emergency surgery where the fallopian tube must be removed. Some women lose one or both tubes, making future pregnancies difficult or impossible. Others suffer massive internal bleeding that results in long hospitalizations, hysterectomies, or death.
The causes of ectopic pregnancy malpractice often include:
Each of these errors represents a preventable breakdown in patient care.
The standard of care requires physicians to consider ectopic pregnancy whenever a woman of reproductive age presents with abdominal pain or vaginal bleeding. At a minimum, this means administering a pregnancy test. If the result is positive, the provider must order appropriate imaging and lab tests to confirm the pregnancy’s location and viability.
Patients with suspected ectopic pregnancy should not be discharged without ruling it out. They must be monitored closely, admitted if necessary, and referred to specialists when appropriate. Failure to take these steps is a deviation from the accepted standard of care.
The consequences of failing to diagnose ectopic pregnancy are devastating. A ruptured fallopian tube causes massive internal bleeding that can lead to shock, organ failure, or death within hours. Survivors may require emergency surgery, often resulting in removal of reproductive organs and permanent infertility.
Even for those who survive, the emotional toll is enormous. Women may grieve both the loss of a pregnancy and the loss of their ability to conceive in the future. Families are left traumatized by the sudden medical emergency and, in fatal cases, the preventable loss of a spouse, daughter, or mother.
The financial toll can also be significant, including prolonged hospitalizations, fertility treatments, lost wages, and ongoing psychological support.

Brian Snyder, attorney, was the only one who took my case more than five years ago. I could not find an attorney in the state of Texas. I spoke to many of the attorneys and law firms throughout Texas. I told them my symptoms were swollen lymph nodes, early signs of a recurrent hernia on my left groin, and I was always in pain. No attorney wanted to help me throughout the state of Texas. Brian Snyder, attorney, took my case without any hesitation. He knew right away what I was going through. Cause of Brian Snyder, I was able to get a settlement payment for an XL mesh plug and onlay. I truly recommend Brian Snyder if any person is experiencing a recurrent hernia or mesh problems. I truly recommend him as an attorney to get you results. I consider Brian Snyder very sneaky, intelligent, with a lot of experience, and a view of common sense. Brian Snyder was very patience and understanding with my case. Brian Snyder is a very bright attorney. I wholeheartedly recommend that you give him a call. I am happy with the settlement and on my way to view and relax by the ocean. Thank you, Brian Snyder, for your help.Posted on Google![]()

One can't begin to convey the immense gratitude we have for David Wenner. We were fortunate to have his highly skilled counsel for our brother, Richard who was involved in a life changing accident through no fault of his own. The enormity of his immediate medical needs and placement in ICU for several months was more complicated with us living out of state. David and his paralegal Jen showed their humanity and compassion in helping us to navigate the insurance and legal issues while staying abreast of Richard's ever-changing condition. They allowed us to concentrate on his care and recovery which was a true blessing. Richard continues to make progress, and he is indebted to David for helping to ensure his care for the future. Thank you, David & Jen !Posted on Google![]()

In my mind they did a excellent job on my case. No pressure one way or the other to do it a certain way. Very happy with the outcome. A shout out to Stephanie she walked (talked) me thru all the computer steps I had to take. OUTSTANDING.
To prove malpractice, attorneys must demonstrate that providers failed to meet the accepted standard of care and that this failure caused harm. Evidence may include emergency room records, lab results, ultrasound findings, and expert testimony from OB-GYN specialists.
For example, if a patient presented with abdominal pain and a positive pregnancy test but was discharged without ultrasound evaluation and later suffered a rupture, that may constitute malpractice. Similarly, if abnormal hormone levels were ignored, liability may be established.
At Snyder & Wenner, P.C., we have decades of experience representing women harmed by failure to diagnose ectopic pregnancies. These cases are especially tragic because timely recognition and treatment can almost always prevent life-threatening complications.
We work with OB-GYN specialists, radiologists, and maternal health experts to uncover negligence and build strong malpractice claims. Our mission is not only to secure compensation for victims and families but also to hold negligent providers accountable so that maternal safety standards improve across the healthcare system.
Liability in these cases may extend to multiple providers and facilities. Emergency room physicians may be responsible for failing to order pregnancy tests or ultrasounds. Radiologists may be liable for misinterpreting imaging results. Primary care doctors or OB-GYNs may face liability for dismissing symptoms or failing to follow up on abnormal findings. Hospitals and urgent care centers may also bear responsibility for systemic issues such as poor protocols or inadequate staffing.
Victims of ectopic pregnancy malpractice may be entitled to substantial compensation, including:
These damages help provide stability for families as they rebuild after preventable harm.
Ectopic pregnancy is one of the most dangerous conditions in early pregnancy, but it is also one of the most preventable causes of maternal death. When doctors fail to diagnose it, women are left vulnerable to ruptures, infertility, and fatal outcomes. These are not inevitable tragedies—they are preventable errors caused by negligence.
At Snyder & Wenner, P.C., we fight for women and families harmed by ectopic pregnancy misdiagnosis. By holding providers accountable, we secure justice and compensation while driving improvements in maternal healthcare standards. Every woman deserves competent, timely care when her life is at risk—and when that standard is violated, we are here to help.
