Did you know that if you are injured in a crash as a passenger in a Lyft or Uber by an underinsured driver, there may not be any insurance coverage to collect from? An Arizona statute, A.R.S. 28-4038, requires ride sharing companies to carry liability and uninsured coverages. Unfortunately, the statute does not require ride sharing companies to carry underinsured coverage. What that means in practical terms is that if an Uber or Lyft driver crashes into someone or is hit by an uninsured driver there will be insurance to pay for injuries, death, and property damage. However, ride sharing companies are not required to carry coverage for your injuries in the event you are injured by a driver who has insurance coverage no matter how small the policy. If you don’t have your own car insurance policy with underinsurance coverage you may be stuck with little to no compensation for your injuries.
It is very important that you carry car insurance that includes underinsured motorist coverage. Hopefully, you never need it, but if you ever find yourself in the backseat of an Uber or Lyft and are in a crash caused by another driver, underinsured motorist coverage will be there to take care of you in your time of need.
